Looming court ruling worries some with health woes

(Reuters) - Texan Sam Lovett had no health insurance in August 2010 when an emergency hospital stay brought news of his doctors that his liver was not and he could die in less than a year without a transplant.
The small warehouse where he worked had no health insurance. Lovett, 43, who lives near Comfort, Texas, was unable to purchase private coverage on their own because of his already poor health. Although he had the means to cover routine medical bills, he now needs a $ 400,000 organ transplant and no doctor or clinic would be him without insurance.
"They were arrangements for me to send to a hospice. Bluntly A doctor told me that I have a better chance of leaving the hospital alive than dead," said Lovett, who had a history of alcoholism and obesity.
But in the months that followed, Lovett was able to enroll in the existing state Insurance Plan (PCIP). The program was created by the health care law by President Barack Obama, a Democrat, signed in March 2010, despite the united opposition of the Republicans in Congress. The program paid for Lovett's transplant surgery at the Mayo Clinic in Phoenix in December last year.
PCIP is a temporary government set to run until 2014, when the Obama health care law is due in full force and insurance companies avoid the common practice of denying people coverage due to preexisting medical conditions. Approximately 60,000 Americans are already receiving medical coverage through the program under the Obama administration.
If the U.S. Supreme Court prepares to in the coming weeks to comment on whether the law considered as Obama's signature domestic policy achievement to overthrow, Lovett said that the choice is very clear to him and others unable to without insurance to get the provisions of the statute's.
"Without this, you will die," Lovett said in an interview arranged by the organization Consumers Union, which supports the law. "From my perspective, that is what the Supreme Court to sanction or not -. Or people may die because they can not get insurance"
Unlike people in many other rich countries, where health insurance is near universal, many Americans struggle without health coverage, even if the country more for healthcare than anywhere in the world pays. The American health care is a patchwork of private insurance and restrictive government measures programs that has left tens of millions uninsured.
Many Americans get health insurance because their employers as a job benefit. But some companies, particularly smaller employers do not provide. People with pre-existing medical conditions are often denied private coverage when they try to buy it on their own.
The Obama law represented the $ 2.6 trillion U.S. health care the biggest overhaul in nearly 50 years. Twenty-six of the 50 U.S. states - including Lovett home state of Texas - and a small business trade group challenged the law in court.
The Supreme Court has heard three days of historical arguments in March over the fate of the law. A ruling is expected by the end of June.
PCIP is only one facet of a law intended to expand coverage to more than 30 million more Americans, competitive health insurance exchanges in all 50 states and create new ways to provide effective care at lower cost to find.
Opponents of the law say that it represents an attack by the federal government to the individual's right to choose health care, interfering in the case of states, and that consumers saddled with higher costs and less access to care.
If the high court designate the law, the provisions immediately invalid.
'Start Over'
Although conservatives revile the law, Republicans and other critics agree something must be done to insurance access to people with preexisting conditions and other health problems. Several Republican bills in Congress would create new insurance polish for the expansion of affordable coverage.
"We need to get rid of the whole thing and start over with a very deliberative process," said Sean Spicer, a spokesman for the Republican National Committee. "There is dual recognition that these are valid issues to be addressed. But we have to do it in a way that no government in the middle of healthcare."
Mitt Romney, the Republican challenger to Obama in the U.S. election on November 6, has called for repeal of the law.
If the entire law or key provisions struck down, it may be difficult for any alternatives through a partisan stalemate in Congress to get even after the elections. Republicans currently control the House and Obama's fellow Democrats in the Senate.
Republican lawmakers working on an alternative health care agenda, the law must be passed. They may try to address some of the more popular consumer protection, such a provision already in force, that young adults remain under their parents health insurance plans at age 26 to recover.
But the uninsured or uninsurable could wait months or years for an alternative plan to help them. Meanwhile, many people without insurance fear that a serious illness can lead to astronomical health care bills and doom them to bankruptcy.
Statistics show that as many as one in four working-age U.S. adults without health insurance in a given year, often as a result of unemployment and job changes.
Helen Berger of Boise, Idaho, said she has not seen since her physician husband, Russ, lost his IT job 10 months ago.
