MERP stands for medical expense reimbursement plan and any plan or scheme whereby a company pays an employee for the out-of-pocket medical expenses of employees or their dependents. When properly administered, all fees paid to the employee 100% tax free. Article 125 is not a MERP Plan, Cafeteria Plan, or flexible spending account. Rather, it is an Article 105 Plan.
How does a MERP WORK?MERPs are essentially a business account for health care - employees need to be converted into revenue reimbursed. These revenues should be kept to 7 years for IRS audit purposes. The IRS will not allow tax deductions through a MERP as the costs are not qualified medical expenses.
A company must establish a MERP (it can not be set by an individual). During the plan set up, the company decides what types of medical expenses.
MERP is a very flexible and can compensate almost all medical expenses an employee can have.
What medical expenses may reimburse MERP?A MERP may reimburse all costs are considered as qualified medical expenses by the IRS, including premiums for individual health insurance policy. Note that the business community, the list of reimbursable expenses to limit in any way they choose.
Some common categories of reimbursable items include:
1. Health Premium2. Doctor Visits3. Dental4. Vision5. Pharmacy6. Hospital7. Over the Counter Drugs (Prescription required)

You need health insurance HAS TO BRING THE MERP?While many companies use a MERP for employees to compensate for the costs of their individual health insurance, a worker is not required to have health insurance to participate in a MERP. MERPs can also be used in conjunction with health savings accounts (HSAs) and flexible spending accounts (FSAS).
Why would a Business a MERP?There are two reasons a company would MERP:
(1) A MERP may reimburse Employees' Out-of-pocket health insurance premiums(2) A MERP allows employers to self-Insure Group Health Plan Deductibles
A MERP is a form of self-insurance. An employer may use a MERP as a way to medical insurance costs, but still relate to the employees qualified medical expenses tax free. In a year when the cumulative medical costs for employees are relatively low, the savings on insurance costs are very important.
For example, if a company reduces health insurance at lower premiums without adding a MERP is that the employer simply shift medical costs from employer to employee. Employees may also then be forced to their higher medical costs with after-tax money to pay. The MERP helps avoid additional costs to the employee.
